This potentially strengthens the Pentagon's hand when negotiating with OpenAI, Google, xAI or another AI supplier:
it can argue that it needs models whose provider-imposed policies will not unexpectedly override authorized military decisions.
Ofcourse, this is an implication of the court's reasoning, not a ruling that every AI contractor must accept unrestricted military use.
Judge Henderson's dissent spells out the opposing implication much more starkly: under the majority's interpretation, another contractor faced with similar demands could have to "Agree to the Secretary's demands or risk being designated a national security threat under FASCSA."
